Even though the issues raised by a criminal defendant's motion for a new trial were based entirely on facts fully known to him at the time of his trial, where the motion Judge considered those issues in the exercise of his discretion he preserved them for consideration on appeal. [535] A criminal defendant, who offered no objection to evidence of a telephone conversation between him and a witness and actively encouraged its introduction, and who, upon discovering that the conversation had been taped, neither moved to strike the conversation nor for a mistrial, waived his rights to complain that the Commonwealth's failure to serve him with a complete copy of the recording as required by G. L. c. 272, § 99 (O) (2), was prejudicial error. [539-541]
